MoneyDart Global Services Inc. (MoneyDart) is a company incorporated under the laws of New York State and has been permitted by the New Jersey State to run a business in New Jersey as a Foreign Corporation. MoneyDart has also been given a money remitter license by the New Jersey State Banking department for facilitating person to person money transfer activity.
For its over the counter business activity limited to the State of New Jersey, MoneyDart accepts transfer orders directly in its retail locations situated in various parts of New Jersey.
MoneyDart has a service partner agreement with UAE Exchange Center - a registered and licensed money transfer company located in the United Arab Emirates to provide the services related to the recipients in the destination countries.
MoneyDart Global Services Inc. also has an agency, sales and service agreement with Vigo Remittances in the USA. Vigo Remittances has the respective licenses and legal clearances to offer direct person to person money transfer facilities in 25 States of USA. Under the MoneyDart / UAE Exchange - Vigo agreement, MoneyDart / UAE Exchange uses the Vigo's legal, administrative, accounting, payment, collection, and computer network system to promote money transfer facilities through the Vigo retail locations to the destination countries which fall under UAE Exchange Center network
MoneyDart offers the mail / fax / telephone / website facilities to users or senders to do a money transfer under the assumption that the final payment by the sender for the transfer order is received by MoneyDart in its account and books maintained in the State of New Jersey. MoneyDart makes sure that the senders contact its offices directly in the State of New Jersey in case they wish to place mail / fax / telephone orders for doing a money transfer. MoneyDart records the information about the sender and the recipient in these cases, only in office locations in the State Of New Jersey. In case of internet based money transfer orders, MoneyDart assumes that senders using the web services fall under the same purview as senders booking a transfer under a mail / fax / telephone system. For Internet transfer orders, MoneyDart is contacted by the sender or user at its website, which is monitored and maintained by MoneyDart through the office location maintained in the State Of New Jersey. On a similar note, MoneyDart also receives the payment for such internet transfer orders in accounts and books maintained in New Jersey institutions

Description of the Service
MoneyDart Global Services Inc. (MoneyDart) provides retail money transfer facility to a user (sender) for transferring retail amount of money to recipient in the designated country.The facility is to provide the services:
Through the retail locations of MoneyDart in the State of New Jersey.
Through the retail locations of Vigo - MoneyDart's agent for other states in the USA
Through fax, mail and direct telephone call to MoneyDart's office in New Jersey and
Through MoneyDart's website over the Internet.
At any point in time, MoneyDart may or may not be able to provide with any or all the stated services and the distribution channels or with any or all the various aspects of the services, mentioned herewith or in any other source of information about MoneyDart.
The Internet Service
The process:
On the Internet, a user can use the MoneyDart site to send money after making payment by using his credit / debit card or by using the electronic fund transfer system. Alternatively, the user can send in all the details of the transfer and then follow up with the payment for the transfer by using the offline payment system (by sending a banker's or certified check, or by crediting the account of MoneyDart directly). MoneyDart may or may not be able to provide any or all the different modes of payments described here at any point in time.
The recipient shall receive the money in three days in the local currency of the designated country in the form of a bank draft or check drawn up by a schedule / registered / nationalized / or government recognized banking institution. All efforts are made to draw the draft or check on a bank branch closest to the recipients address and to deliver the same within 3 days - although MoneyDart may not be able to fulfill this condition every time due to circumstances which are not in its control. The delivery of the draft or check is done through a courier or postal agency located in the designated country.
UAE Exchange, our service provider in the destination country:
MoneyDart uses the services of its service partner - UAE Exchange Center, a recognized money transfer agency located in the country of United Arab Emirates, to complete the transaction process in the designated countries. UAE Exchange further uses the services of its agents and correspondents to complete a transaction till the delivery point for the recipient. User Registration and order process:
For doing an online transfer to the recipient, the user shall have to register himself on the given format and shall have to enter all the information as required. The user is required to read, understand and agree with all the Terms and Conditions which fall under the purview of the Member / User Registration and Service Agreement The user shall be allotted a unique Login I.D. number and a password. Only after completing the registration process the user is allowed to do a transfer. The user shall have to give all the required information of the recipient. The user shall also give the principal amount in US Dollars or the local currency amount of the transfer he desires to send. The user shall then input the details of his / her credit or debit card or the bank details (in case of an electronic funds transfer) for making the payment for the transfer. The final amount that the user shall pay will also include the fees charged by MoneyDart for facilitating the transfer and shall be denominated in US Dollar. Once the user is registered, each time he / she does a transfer, he / she shall have to enter his login I.D. and password to gain access to the transfer system. In case the user is using the offline payment system for paying for the transfer order, the final transfer to the recipient shall be done only after MoneyDart receives the actual payment for the order from the user.
Payment Gateway, Credit - Debit Card / Electronic Funds Transfer / User payment details verification:
MoneyDart shall use the services of a reliable and secured USA based payment gateway system to verify the information related to the credit or debit card or the electronic funds transfer system used in the process. If the information given by the user is verified and approved, the payment gateway system shall then authorize the card processing institution or the electronic fund transfer processing institution to charge the user's card or bank account for the US dollar equivalent of the amount being transferred plus the fees charged by MoneyDart. Please note that the user's card issuing institution may treat this transaction as cash advance. The user shall fall under all the rules of its card issuing institution regarding the use of his card in this connection. MoneyDart shall complete the transfer order only after it is satisfied that the user has successfully paid for the amount to be transferred and the fees charged, through any of the described channel of payment.
Fees charged:
The user shall pay a fee for the principal amount of money being transferred. The schedule of fee is mentioned under the Pricing and Transfer Limit page. The fees charged are subject to change. The website shall always be updated if there is any change in the fee schedule.
Currency Exchange Rate Applied / Payment to Recipient:
MoneyDart shall make all the payments to the recipient in the local currency of the destination country. MoneyDart uses a competitive exchange rate for payments. MoneyDart shall make all efforts to apply the' exchange rate quoted on a particular date in its 'Currency and Forex Calculator' page for issuing the draft in the destination country. However, fluctuations in the global currency market can sometime affect this exchange rate policy. The rates quoted and applied by MoneyDart are final and cannot change under any circumstances. MoneyDart strives to update the exchange rates periodically by keenly following the global currency markets to closely reflect the parity between USD and the currency rate of the destination country.
MoneyDart keeps the difference between the rate, which MoneyDart gets, and what is applied to the user transfer amount. This is in addition to the transfer fee which MoneyDart charges to its user.
Limits to amounts sent under different modes of payments through the internet:
Currently MoneyDart has put in certain limits to the amount of money which a user can sent under the different modes of payments available to him / her. The upward limit are as follows
For Credit Card Payments: The upward limit is $500.00
For Electronic Funds Transfer Payments: The limit is $750.00
For Off-line Payments: There are no transfer limits.
The user should note that these are limits set up by MoneyDart and are subject to change at MoneyDart's discretion. Such changes shall be duly advised on the website and the user should always consult the Pricing and Transfer Limit pages for updated information. In addition to these limits, there may be other statutory requirements, related to limits, reporting and filling up of relevant declaration forms as prescribed by the laws of the State under which the Internet money transfer activity may fall.
Order cancellation and Refund:
MoneyDart has a strict cancellation policy for a booked money transfer order. Due to logistical difficulties and the exchange rate complications, the user is best advised to confirm his transfer order only when he is fully ready. In certain cases, the user's request for a cancellation of a booked transfer may be acted upon if the payment has not been transferred in the form of a draft or check, and MoneyDart is able to halt the final payment to the recipient. In such cases, the user shall be refunded the USD equivalent of the local currency, and the conversion shall be done at the exchange rate prevailing on the day the cancelled amount is finally cleared by MoneyDart. This rate can be different from the rate applied earlier while booking the order and it can also entail a monetary loss to the user. The user shall not be refunded the fees charged earlier to do the transfer. In case of any exchange rate dispute, MoneyDart reserves the right to use its discretion. The refund process depends upon many factors, and MoneyDart cannot guarantee the final outcome. MoneyDart however shall make its best effort to help user in genuine cases. MoneyDart, under no circumstances, can refund a money transfer amount, which has been finally delivered to a recipient. For all cancellation requests, the user shall contact the MoneyDart customer service area at 1 866 DRAFTS 4U (372 3874). The user's telephonic request shall have to be followed by a written request and confirmation. MoneyDart shall try to complete the refund within thirty days of receiving the written request. MoneyDart shall make the refund only in form of check drawn in favor of the original sender.
The designated recipient has to accept a money transfer in its name within one year of the date it was ordered by the sender. Otherwise, MoneyDart shall make all the efforts to refund the same to the sender. In doing so, MoneyDart shall follow the clauses as given under its cancellation policy including the exchange rate and fee policies. MoneyDart shall also levy an extra administrative charge of $15 to do the refund, and it shall be deducted from the principal amount of transfer.
In case of error committed in executing a booked money transfer order, for reasons which fall within the purview of MoneyDart's service parameters, MoneyDart shall first try to rectify the situation, failing which it shall refund the full principal amount in USD including the fee charged to the user at his / her request. MoneyDart gives no such commitment for refund for errors which are committed in the money transfer process due to the wrong information provided by the sender or for reasons which are totally outside the control of MoneyDart and its service partners.
MoneyDart's liabilities and other responsibilities in such cases shall strictly fall under the clauses given in the Terms and Conditions governing the Member / User Internet Registration and Service Agreement with MoneyDart. MoneyDart shall not be responsible for any non-performance or loss resulting from war, revolution, civil unrest, and insurrection or from any law, decree, moratorium or local regulations or of domestic or foreign government, de jure or de facto. MoneyDart's liability is limited to the amount collected and in no event MoneyDart shall be liable for damages for delay, non-delivery, nonpayment or underpayment of this money transfer whether due to the mistake or omission of MoneyDart or its service partners, for more than the total amount collected from the sender, except as otherwise provided by the law.

The sender / user 's information
We collect the sender's address, name, contact numbers, email address, credit or debit card details or the bank account details. This information is essential for completing the transaction ordered by you.
The recipient's information:
We collect the recipient's name, address, and contact numbers, email address and the bank account number. Again, this information is required to complete a transaction at the recipient's end.
Information required by the payment gateway / credit card or debit card processor / electronic fund transfer processor / MoneyDart's BackOffice for offline payments:
To make sure that we receive the payment for completing a transfer order in good faith, our payment gateway provider and the merchant account processor for the credit or debit cards need to get your (user) credit or debit card details. Similarly the Electronic Fund Transfer processor need to get your bank account details. The MoneyDart's back office gets the details either of the wire instructions being used or the certified check or banker's check being sent by the user to make an off-line payment. In each such case, the relevant details are only used to verify and process the payment for the particular transaction. While protecting the interest of MoneyDart (so that it is correctly paid for transfer order), these service providers - by following an elaborate system of verification, also make sure that you or the user is protected against fraudulent and unauthorized use of your paying instrument.
MoneyDart always selects the most appropriate payment gateway, merchant account and electronic funds transfer provider.

We also need to know the amount in USD which you are proposing to send, to whom it is being sent, and what method of payment you are going to use for doing the transfer.

It is MoneyDart's policy to respect the privacy of its members. MoneyDart will not monitor, edit, or disclose any personal information about you or your use of our services, including its contents, without your prior permission unless MoneyDart has a good faith belief that such action is necessary to :
